Terms of Service

GameSense (gamesense.coach)

GameSense is a limited liability company incorporated under the laws of the Netherlands, having its office address at Laan van Kronenburg 14, 1183 AS Amstelveen, The Netherlands, and registered with the Chamber of Commerce under number 92153488 ("GameSense", "we", "us", "our").

By using GameSense, you agree to these terms. If you do not agree, do not use the service.

1. Service Description

GameSense is a web application for creating interactive video-based quizzes for sports coaching and tactical education. The service allows:

  • Coaches to upload match footage, create video clips, add questions (manually or with AI assistance), and share quizzes with players

  • Players to view video clips, answer questions, and receive feedback on their responses

2. Account Types and Responsibilities

2.1 Coach Accounts

Coaches can create quizzes, upload videos, invite players, and review responses. As a coach, you are responsible for:

  • The content you upload, including having appropriate rights to any video footage

  • Obtaining consent from individuals identifiable in video footage, or ensuring your club/organisation has done so

  • If working with minors (under 16), obtaining parental or guardian consent before inviting them to take quizzes

  • Managing access to your quizzes via share codes

2.2 Player Accounts

Players can take quizzes shared with them by coaches. Players provide their name and email when submitting quiz responses.

2.3 Account Security

You are responsible for maintaining the security of your account credentials. Notify us immediately at info@gamesense.coach if you suspect unauthorised access to your account.

3. Acceptable Use

You agree to use GameSense only for legitimate sports coaching and education purposes. You must not:

  • Upload content that is illegal, harmful, threatening, abusive, or otherwise objectionable

  • Upload content that you do not own or have the right to use

  • Upload content unrelated to sports training or education

  • Attempt to gain unauthorised access to other accounts or our systems

  • Use the service to send spam or unsolicited communications

  • Reverse-engineer, decompile, or attempt to extract the source code of the service

  • Use automated tools to scrape or extract data from the service

  • Interfere with or disrupt the service or its infrastructure

4. Video Content

4.1 Ownership

You retain ownership of all video content you upload. By uploading, you grant GameSense a limited licence to store, process, stream, and create clips from your videos solely to provide the service.

4.2 Rights and Consent

You represent that:

  • You own the video content or have obtained all necessary rights and permissions to upload it

  • You have obtained appropriate consent from identifiable individuals in the footage (or your club/organisation has obtained it on your behalf)

  • The content does not infringe any third party's intellectual property, privacy, or other rights

4.3 Video Processing

Videos are hosted and streamed by our video provider (Mux). Video clips are generated at timestamps you define. We do not edit or alter video content beyond clipping.

5. AI Features

GameSense offers optional AI-powered features:

  • AI question generation — suggests questions based on clip descriptions you provide

  • AI answer grading — compares player answers against expected answers and provides scores and feedback

5.1 Limitations

AI-generated content (questions, scores, feedback) is provided as a suggestion and educational aid only. It is not a substitute for professional coaching judgement. AI outputs may contain errors or inaccuracies.

5.2 Data Processing

AI features are powered by OpenAI. Only text data (clip labels, questions, answers) is sent to OpenAI — video data is never sent to AI providers. See our Privacy Policy for details.

5.3 Availability

AI features are available on trial and pro subscription tiers. We may modify, limit, or discontinue AI features at any time.

6. Subscription Tiers

6.1 Tiers

GameSense offers the following tiers:

  • Free — basic quiz creation with limited features

  • Trial — time-limited access to all features including AI

  • Pro — full access to all features

6.2 Pricing

Pricing for pro subscriptions is as displayed at the time of purchase. We reserve the right to change pricing with reasonable notice. Price changes do not affect active subscription periods.

6.3 No Refunds

Subscription fees are non-refundable except where required by applicable law.

7. Intellectual Property

7.1 Your Content

You retain ownership of all content you create or upload (videos, questions, annotations). By making content available through GameSense, you grant us a global, non-exclusive, transferable, royalty-free licence to use, edit, reproduce, and display this content as necessary to operate and provide the service. This licence continues for as long as your content remains on the platform and terminates when you delete your content or account.

7.2 Our Service

GameSense, including its design, features, code, and branding, is owned by us and protected by intellectual property laws. You may not copy, modify, or create derivative works from the service.

7.3 Feedback

If you provide suggestions, feedback, or ideas regarding the service (including but not limited to feature requests, improvements, or corrections), such feedback shall be deemed the property of GameSense. We may freely use, incorporate, disclose, or distribute such feedback for any purpose without obligation or compensation to you.

8. Third-Party Integrations

8.1 Marketing

By using GameSense, you agree that we may use the name of your club or organisation for marketing purposes in connection with the GameSense platform (e.g. listing as a customer on our website). If you do not wish your club name to be used, contact us at info@gamesense.coach.

8.2 ClubOS

If your club uses ClubOS, GameSense can sync team and player data. This integration is optional. Data synced from ClubOS is subject to your club's agreement with ClubOS.

8.3 Third-Party Services

The service relies on third-party providers (see our Privacy Policy for the full list). We are not responsible for the availability or practices of these third-party services beyond our contractual agreements with them.

9. Termination

9.1 By You

You may delete your account at any time. Upon deletion, your personal data and associated content (including videos) will be removed in accordance with our Privacy Policy.

9.2 By Us

We may suspend or terminate your account if you:

  • Violate these terms

  • Use the service for purposes other than sports coaching/education

  • Upload inappropriate or illegal content

  • Engage in abusive behaviour toward other users or our team

We will provide notice before termination where practicable, unless the violation requires immediate action.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The service will be uninterrupted, secure, or error-free

  • AI-generated content will be accurate, complete, or suitable for any particular purpose

  • Video processing or streaming will be available at all times

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GAMESENSE AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Our total liability for any claim arising from your use of the service shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold GameSense harmless from any claims, damages, or expenses arising from:

  • Your use of the service

  • Content you upload or create

  • Your violation of these terms

  • Your violation of any third party's rights

13. Governing Law and Disputes

These terms are governed by the laws of the Netherlands. Any disputes shall be resolved in the courts of the Netherlands, unless mandatory consumer protection laws in your jurisdiction provide otherwise.

14. Changes to These Terms

We may update these terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of the service after changes constitutes acceptance of the updated terms.

For significant changes, we will notify you via email or in-app notification at least 14 days before they take effect.

15. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These terms, together with our Privacy Policy, constitute the entire agreement between you and GameSense regarding your use of the service.
